The www.melandofficiel.com website and related services are made available to sell ME.LAND products in accordance with the following terms and conditions. Please read carefully below before placing your orders on www.melandofficiel.com

1. General

Any order placed by the buyer implies unreserved acceptance of these General Terms and Conditions of Sale established by ME.LAND, which the buyer acknowledges having read.

No contrary provision (purchase conditions, etc.) unilaterally established by the buyer may be opposed to ME.LAND if it has not been previously and expressly accepted.

The failure to invoke, at any given time, any of the provisions of these General Terms and Conditions of Sale cannot be interpreted by the buyer as a waiver by ME.LAND to subsequently invoke any of said Conditions.

These General Terms and Conditions of Sale may be modified at any time, it being understood that any eventual modification will be notified to the buyer and will take effect two months after receipt of the notification.

1. Product availability

The items displayed on the website reflect the actual availability of the item in terms of color and size. Once the order is processed by our logistics department, we reserve the right to reconfirm the availability of the merchandise, to verify the validity of the transaction. Customers will be informed if, for any reason, the ordered item is not available or if the order cannot be sent in accordance with the customer's request.

1. Price

Products are supplied at the price in force on the day of the order, the buyer declaring having read the prices before contracting and accepting them according to the conditions defined on the order form.

1. Payment

Payments can be made securely online. By submitting an order on the website, you confirm and guarantee that the payment details provided in accordance with your order are valid and correct. Card payments can be made with the indicated cards. By submitting an order, you immediately authorize ME.LAND S.A.S to charge your debit or credit card with the order payment upon presentation of your order and implies that you intend to pay ME.LAND S.A.S if your order is accepted.

1. Shipping – delivery – transport

The respective responsibilities of ME.LAND and the buyer are defined in accordance with the "Ex Works" Incoterm of the International Chamber of Commerce, unless otherwise stipulated on the order form for a free delivery.

ME.LAND's responsibility ceases upon delivery of the packages to the carrier. The buyer alone will bear the burden of the risks related to the products, including those of transport, from the departure of the products from the supplier's premises. The delivery note issued to the carrier will constitute proof of delivery.

All duties and taxes are the responsibility of the customer.

In case of refusal of delivery by the buyer, the latter will still be charged for duties and taxes. Your item will be returned to ME.LAND S.A.S and you will be directly charged for unpaid duties and taxes as well as additional shipping costs.

Order preparation time varies depending on the destination country.

France: 2 to 4 working days

Europe: 3 to 5 working days

Rest of the world: approximately 5 working days

During year-end holidays or summer holidays, this time may vary.

Delivery times vary depending on the carriers. On average, it is necessary to allow:

France: 4 to 5 working days

Europe: 4 to 5 working days

Rest of the world: approximately 10 working days

Costs also vary depending on the country of delivery and will be charged to the customer.

France and Europe: Free delivery from 80 €

Rest of the world: 15 to 70 euros

1. Delivery time

Delivery times are those indicated above by ME.LAND. Failure by ME.LAND to deliver on the scheduled date does not entitle the buyer to any compensation whatsoever. In case of late delivery, no total or partial cancellation of an order will be accepted by ME.LAND.

1. Force majeure

In the event that, due to a force majeure event, ME.LAND cannot execute the order in whole or in part, particularly in the event of non-delivery of raw materials by a supplier, the buyer may not hold ME.LAND liable and the sale will be automatically cancelled.

1. Claims

Our after-sales service only concerns products purchased on the www.melandofficiel.com e-shop.

For any claim, please send an e-mail to contact@melandofficiel.com with photos of the item you consider defective.

Items are "defective" if they do not meet our quality standards, which require that products match their description on the website and are of satisfactory quality. We consider an item not to be of satisfactory quality if it shows visible and obvious damage, such as scratches or stains. If you receive damaged laces, we will only send you new laces, and not entire shoes. If you receive defective purchased products, you have the right, within 48 hours from the date of receipt of the products, to request a repair, exchange or refund, at our discretion. The buyer may under no circumstances return products without ME.LAND's prior written authorization.

After this 48-hour period, any type of claim concerning defective products will be considered invalid.

If the claim is justified, the return will be subject to an exchange or, if impossible, a credit note. In this case, return costs will be reimbursed by ME.LAND. Products delivered in conformity with the order will not be taken back or exchanged.

1. Returns

Before proceeding with any return, contact us at contact@melandofficiel.com and we will send you the procedure to follow.

Please note that in case of a return not validated by ME.LAND, shipping costs are the responsibility of the customer.

We only accept returns of products purchased on our e-shop. Any return will be subject to an exchange or a credit note. When requesting a return, you must specify it and state the reason within 15 days from the date of receipt of your order.

All purchased and returned products must be returned in their original, unused, undamaged, unstained condition, in their original ME.LAND box. We are not obliged to accept returns that do not meet the above conditions and we may refuse a refund in this case and return the products concerned at the customer's expense.

1. Industrial and artistic property rights

All industrial and artistic property rights to product brands and designs belong exclusively to ME.LAND. Reproduction, representation and adaptation of ME.LAND brands and designs are strictly prohibited, in any form whatsoever (photos, sketches, canvas or paper patterns...).
Failure to comply with this article and with legal provisions concerning industrial and artistic property would constitute an act of counterfeiting and/or unfair competition, punishable by applicable laws and likely to lead, in particular, to the award of damages.

1. Personal data

Within the framework of this Article, words beginning with a capital letter have the meaning given to them by the General Data Protection Regulation (“GDPR”) adopted on 27/04/2016 and applicable since 25/05/2018.

The buyer undertakes to comply with all obligations incumbent upon him under the GDPR and assumes sole responsibility for the consequences resulting from non-compliance with these obligations. In the event that he is required to communicate Personal Data to ME.LAND, in its capacity as Data Controller, the buyer will be responsible for collecting and processing the data in accordance with the GDPR and, in particular, for obtaining consent or informing the data subjects of the characteristics of the Processing by ME.LAND.

For all practical purposes, the buyer is informed that ME.LAND S.A.S collects and processes identification data for the purpose of concluding and executing the order, and more broadly for managing their commercial relationship. The buyer undertakes to immediately inform ME.LAND of any request from the buyer, or from an administrative or judicial authority relating to Personal Data Processed by ME.LAND S.A.S.

1. Applicable law and jurisdiction

The law applicable to these General Terms and Conditions of Sale is French law. The application of the Vienna Convention on the International Sale of Goods is expressly excluded. The language of interpretation is French. All disputes to which these General Terms and Conditions of Sale may give rise will be submitted to the competent courts within the jurisdiction of the Paris Court of Appeal.
